ACTION DEMOCRATIC PARTY (ADP) MOVES TO STOP PETER MBAH’S INAUGURATION AS EXECUTIVE GOVERNOR OF ENUGU STATE

The Governorship candidate of the *Action Democratic Party (ADP)’ Hon NNAMDI OMEJE,* has moved through his Counsel, *Ozo Alex Amujiogu Esq and Hon Johnnoble .C Eze Esq,* among other lawyers, to stop the forthcoming inauguration and /or swearing in of Barr Peter Ndubuisi Mbah as the incoming Executive Governor of Enugu State.

In a petition brought before the Governorship Election Petition Tribunal, holding in Enugu in *EPT/EN/GOV/02/2023,* the Petitioners through their Motion, are urging the tribunal to make an interlocutory order of injunction restraining the Governor -elect Peter Ndubuisi Mbah from presenting himself ,for the purposes of being sworn in or inaugurated as the Executive Governor of Enugu State come May 29, 2023.

According to Amujiogu Esq, the gravamen necessitating the said application is that the 2nd Respondent (Barr Peter Mbah) should not be allowed in any form to *steal a match against* the applicants by putting himself forward in order to be inaugurated as the new Governor of Enugu State during the pendency of this petition which is already subjudice.

Moreso, by the doctrine of lis pendence, the said Office ought not to be tampered with by any of the parties to the petition until Justice is done in this matter.

He urged the tribunal to use the eye of an eagle to ensure the preservation and securement of the res in dispute which is the Office of the Governor of Enugu State by ensuring that the 2nd Respondent does not occupy the said seat while the petition is on top gear.

May 12,2023 has been slated for the hearing of the motion on notice,the Tribunal had already ordered on 3/5/2023 that the Respondents should be served through “substituted means for immediate response.”

Responding to press men, Hon. Omeje the ADP Guber candidate made it clear that 2023 tribunal cases are indeed a trying time for judges in Nigeria because the whole world are waiting and watching to see what shall become the hope of a common man in Nigeria, and the people are expecting to see the saying that say that judiciary is the last hope of a common man been made manifest.
He continued to say that “NDI Enugu cannot afford to go the way of Anambra State and Imo State where the tax payers money was wrongly spent on people whom the people did no vote for.”

Omeje also said that we are yet to know who will pilot the affairs of Enugu State because there are tribunal cases on that.

He urged his supporters and public to be law abiding and stay calm for the judiciary, saying” he has confidence that the tribunal will carry out their duty with the mind of justice.”
