Justice Omotosho Explains Why Mercy Guided Nnamdi Kanu’s Life Sentence Over Death Penalty

Justice James Omotosho of the Federal High Court in Abuja has revealed why he sentenced Indigenous People of Biafra (IPOB) leader Nnamdi Kanu to life imprisonment instead of the death penalty.

The ruling came on Thursday, November 20, 2025, after Kanu was found guilty on multiple terrorism-related charges.

During proceedings, the prosecution, led by Senior Advocate of Nigeria (SAN) Adegboyega Awomolo, recommended the death penalty, arguing it was appropriate for the offenses.

However, Justice Omotosho opted for mercy, citing global trends away from capital punishment and teachings from the Holy Book that emphasize compassion.

Quoting Matthew, the judge said, “Jesus Christ taught His followers to show mercy,” explaining that this guided his decision to reject the death sentence.

While the law permits capital punishment, he concluded that a life sentence would be more appropriate and humane.

The court also ruled that Kanu should not be held at Kuje Correctional Centre, deeming it unsuitable. Instead, he will be placed in a secure location approved by authorities, with protective custody arrangements reflecting both the seriousness of his sentence and his safety.

Kanu will face strict limits on the use of electronic devices, with access allowed only under supervision by the Office of the National Security Adviser. Additionally, the federal government is ordered to seize IPOB broadcasting equipment used in connection with his activities.
