The High Court in Benue State issues a restraining order against the Peoples Democratic Party regarding the local government congresses.
In a recent development at the High Court in Gboko, Benue State, a ruling has been issued to block the Peoples Democratic Party from moving forward with the upcoming congress planned for Saturday, August 10, 2024 in six specific local government areas.
This injunction came about as a result of a motion ex parte presented before the court and endorsed by Justice J. M. Ayua.
The individuals who initiated this legal action, namely Senator Orker Jev, Terseer Tsumba, Aondoyina Grace, Tergun Tsegba, along with 13 others, are listed as applicants in the originating summons.
Represented by F.T. Anongo and other legal representatives, the applicants sought a legal restraining order to halt the party from conducting local government congresses until the circumstances surrounding the absence of the ward congress held on July 27, 2024, within the aforementioned local government areas are properly addressed.
The localities impacted by this legal restriction are Buruku, Gboko, Guma, Kwande, Ushongo, and Konshisha.
The respondents in this case include the Peoples Democratic Party, its acting national chairman, national organizing secretary, and the state chairman of the party, John Ngbede.
The interim restraining order issued explicitly prohibits the respondents, their agents, employees, or associates from proceeding with the local government congress election supposed to take place on August 10, 2024, specifically in the identified six local governments within Benue State.
Furthermore, a subsequent hearing on the matter has been scheduled for August 18, 2024, indicating that the legal proceedings surrounding this case are ongoing and will be continued to be deliberated upon by the court.
