Court order obtained by Ganduje prevents ward leaders from suspending him.

A ruling by the Federal High Court in Kano, overseen by Justice A.M Liman, has prohibited the executive members of the APC Ganduje Ward from suspending the National Chairman of the party and ex-Kano State Governor, Dr. Abdullahi Umar Ganduje until a full hearing takes place on the fundamental rights application brought before the court.

Dr. Ganduje, as the applicant, sought the protection of his rights to fair hearing and freedom of association, citing the Enforcement and Procedure Rules of 2009 and Section 46 of the Constitution of the Federal Republic of Nigeria, 1999 as amended, through his legal representative, Barrister Hadiza Nasir Ahmed.

Justice Liman issued the restraining order following an ex parte motion presented by Barrister Hadiza Nasir Ahmed.

The judge mandated all involved parties to uphold the existing state of affairs before the emergency meeting supposedly held by the APC Ganduje Ward’s executive members at an undisclosed location, and instructed a halt on any actions related to the issue until the motion on notice is heard and resolved.

“That all the Respondents, their servants, agents or privies are hereby restrained from implementing and or given effect to the purported decision reached during the purported Emergency Meeting of the alleged Executive Members of APC Ganduje Ward, on the 20 April, 2024 pending the hearing and determination of the substantive application for the enforcement of fundamental rights of the Applicant.

“That all the parties are hereby mandated to maintain status quo before the purported Emergency Meeting of the alleged Executive Members of APC Ganduje Ward, held at unknown location and to stay all actions in respect of this matter, pending the hearing and determination of the substantive application”.
